Our Health Care Practice Area The health care practice at Quinlivan & Hughes, P.A. is structured to lend legal assistance to all types of health care providers. The business of health care increases in its complexity each year as compliance with Medicare, Medicaid, licensure and business regulations becomes more and more challenging. The "business of health care" includes formation of practice partnerships, incorporation, general counsel, employment issues, contract review/negotiations, licensure issues, consultations and administrative / court procedures. We provide legal assistance to various providers, e.g. hospitals, nursing homes, doctors, dentists, psychologists, chiropractors, home health care agencies, pharmacies and more. We work with all types of professionals and institutions involved with the "business of health care." We offer a "legal audit" to health care providers. We can help providers evaluate or implement a "compliance program." As part of our "compliance" initiative, we offer the ability for providers to "outsource" the chief compliance officer role and/or an employee "hotline" service to help avoid whistleblower and qui tam initiatives. The Department of Justice has recovered billions under the False Claims Act. The majority of these recoveries are related to health care fraud cases. In Minnesota, Allina recently agreed to a $16 million dollar settlement with the government. In August 2001, a U.S. District Court judge imposed a $1.6 million dollar penalty against a nursing home in Morris, MN for Medicaid fraud. The government's interest in health care continues to rise in parallel with the cost increases associated with taxpayer funding of the Medicare and Medicaid programs.
